What is MoCRA and What Does it Mean for Your Cosmetics Business?

As of July 1st, 2024, MoCRA (Modernization of Cosmetics Regulation Act) has been put into place to establish transparency and efficacy between the cosmetics industry and consumers. This act was signed into law in December of 2022, but now goes into effect, instilling a variety of regulations in the industry.

How Does MoCRA Affect My Cosmetics Business?

This act simply enacts more regulations on the industry, making companies more transparent and compliant with FDA guidelines. There are several requirements for companies to abide by in order to remain compliant with the FDA:

  • Enhanced Record Keeping & Event Reporting:

Manufacturers are required to keep records of any health-related events pertaining to their products for six years. Any adverse event that occurs must be reported within two weeks of the issue first being reported.
  • Registration for Facility and Product/Ingredient Listing:

Your manufacturing facility must be registered with the FDA. The products and their ingredients must also be listed with the FDA.
  • Ensuring Safety with Your Cosmetics:

Manufacturers of cosmetic and personal care products must keep records of the safety of their products. These documents should demonstrate “adequate substantiation” for the safety of the products, verified by a third-party testing lab.
  • Labeling & Allergen Transparency:

Cosmetics manufacturers will be required to have product labels that provide ingredients for fragrances (for potential allergens) and contact information so consumers can easily report any adverse effects. If the product is intended only for licensed professionals, the label should indicate that.

How Will the FDA Enforce These Requirements?

Following the FDA requirements with your cosmetic products should result in any repercussions. However, failure to do so, or not reporting any adverse health effects may result in some acts of enforcement, such as the suspension of your facility and its operations, or a mandatory recall if they determine one or more of your products has been adulterated, misbranded, or exposed to any harmful substances.

How to Ensure My Cosmetic Business & Products Comply?

It’s important to follow all of the requirements listed by the FDA under MoCRA to ensure that your products are compliant under these new sets of regulations. The important thing is to follow these guidelines closely, and to report any instance of health-related issues due to use of your products.

To better maintain the safety of your products, consulting a chemical testing lab will help you determine if there’s any potential risks with your products. Various tests can be conducted to determine if the product is safe for human applications and if there’s any potential allergens present.
